Since law school, Mr. McCarty’s focus has been litigation. During law school, he was a Moot Court Champion. Prior to graduating from law school he was appointed by the Illinois Supreme Court as a Rule 7-11 Student, which allowed him to prosecute criminals for the Kane County State’s Attorney’s Office under the supervision of other licensed attorneys, before his admittance to the Bar. After his graduation and admittance to the Bar, he was appointed as a Kane County Assistant State’s Attorney with offices in Elgin and St. Charles, Illinois, during which time he prosecuted all manners of crimes from simple traffic violations to serious felonies.
After five years as an Assistant D.A., Mr. McCarty opened his private practice in Elgin, Illinois. Eventually, he joined the Law Firm of McCuaig, Haeger, Bolz & McCarty in Dundee, Illinois. The firm has changed over the years to Bolz & McCarty, LLC, as it's been for the past 25 years. As a firm partner, he was appointed as a Special Assistant Attorney General by Attorneys General Jim Ryan and Lisa Madigan. While in that position he was charged with prosecuting various eminent domain and condemnation cases in Will, DuPage, Kane, and McHenry counties. Additionally, he was in charge of the expansion and development and condemnation of roadways including, but not limited to, the Route 355 and Lake Street project, the expansion of the St. Charles Bridge in downtown St. Charles, and the widening and expansion of the intersection of Route 31 and 14 in Crystal Lake, Illinois.
While in private practice, Mr. McCarty has primarily focused his practice in the areas of family law and personal injury. He has handled all matters of family law litigation, from simple to complex cases involving multiple millions including complex stock and stock options as well as valuing complex financial transactions and the valuation of closely held small businesses. Attorney McCarty has taken many cases to verdict involving custody and visitation issues, including those using expert opinion witnesses. Included in his experience has been matters involving domestic violence, removal from the State of Illinois, single parents, and all matters of custody, visitation, support, maintenance, alimony and asset division as well as liability assignment.
Mr. McCarty is frequently invited to speak at various events and seminars. Recently, he was a speaker at the Kane County Bar Association Family Law Seminar, where he discussed “Medical Shield Law” as it relates to custody disputes and whether a divorcing spouse can obtain the medical records of the other spouse in the event of mental illness and a custody dispute between the parties.
Attorney McCarty and his firm have settled millions of dollars in injury litigation. These include automobile accidents cases, dismemberment cases, dog bite cases, slip and fall cases, and wrongful death cases, workers compensation, and medical malpractice.
Mr. McCarty has always been extremely involved in the community, including coaching both his son and daughter at various baseball, softball, and basketball activities. He is currently a Board of Director for the Boys and Girls Club of Elgin and he was awarded the Boys and girls of Elgin Volunteer of the Year for 2005.
Mr. McCarty is a frequent visitor to the counties of Kane, McHenry, DeKalb, DuPage and western Cook Counties. With more than 30 years of experience in complex matters and many hours of litigation, he has acquired a unique, experienced, and informed view of the courtroom and various venues including jury trials and trials by court.
